By downloading, installing, or using Landscape Designer ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.
2. Description of Service
Landscape Designer is a mobile application that provides AI-powered landscape design generation, augmented reality plant visualization, plant identification, and a plant catalog. Some features require a paid subscription or credit purchases.
3. User Accounts
The App does not require traditional user accounts. Your data is stored locally on your device and associated with your Apple ID for subscription management through RevenueCat.
4. Subscriptions and Purchases
4.1 Premium Subscriptions
- Subscriptions are billed through the Apple App Store
- Prices are displayed in your local currency
- Subscriptions auto-renew unless cancelled
- Cancel through your App Store account settings
4.2 Credit Purchases
- AI design and plant identification credits are consumable purchases
- Credits do not expire
- Credits are non-refundable except as required by law
4.3 Free Trial
New users may receive a free trial period. You will not be charged during the trial. If you do not cancel before the trial ends, your subscription will automatically begin.
5. User Content
You retain ownership of photos and content you create using the App. By using our AI features, you grant us a license to process your photos for the purpose of generating landscape designs or identifying plants.
6. Acceptable Use
You agree not to:
- Use the App for any illegal purpose
- Upload inappropriate or offensive content
- Attempt to reverse engineer the App
- Circumvent any security measures
- Use automated systems to access the App
7. Intellectual Property
The App, including its design, code, and content, is protected by copyright and other intellectual property laws. You may not copy, modify, or distribute any part of the App without our written permission.
8. AI-Generated Content
Landscape designs generated by AI are provided for visualization purposes. Results may vary and should not be considered professional landscape design advice. Always consult with qualified professionals for major landscaping projects.
9. Plant Information Disclaimer
Plant information, including hardiness zones, care instructions, and identification results, is provided for educational purposes. We do not guarantee accuracy. Plant identification results should be verified, especially for plants that may be toxic or dangerous.
10. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the App.
11. Modifications to Service
We reserve the right to modify, suspend, or discontinue the App or any features at any time without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation.
12. Changes to Terms
We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
